Who can use Sole Mates
You need to be 13 or older. If you’re under 18, you need a parent or guardian’s permission, and by letting you use Sole Mates they agree to these terms on your behalf and are responsible for your use of it. One account per person, and only for yourself. Sole Mates is designed for people in the United States.
Your account
You sign in with Apple, or with your email address and a code we send. Keep your phone, Apple Account and email secure, because anyone using them can use your Sole Mates account. You’re responsible for what happens on your account. If you think someone else is using it, email us right away.
Names, usernames and group names
Your first name, last initial and @username are visible to other people on Sole Mates, and group names are visible to everyone in the group. Use a name you have the right to use. Don’t use slurs, threats, other people’s names, or anything meant to offend, impersonate or mislead. You give us permission to show your name, @username and group names to other people on Sole Mates, as these terms and our Privacy Policy describe. We may change or remove a name that breaks these terms.
Fair play
Don’t add steps by hand, use devices or apps that fake steps, or tamper with the app or your data. Steps typed into Apple Health by hand don’t count. We may remove steps, results or accounts that look faked, without telling you first. We decide in good faith which steps and results count, and challenge results are final once they’re announced, even if steps sync late.
Conduct
Don’t harass, threaten or impersonate anyone. You can block anyone, and you can report them from the same menu. We review reports and may suspend or remove accounts that break these terms.
Your health
Sole Mates is for fun and motivation. It isn’t medical advice, it isn’t a medical device, and step counts can be wrong. Talk to a doctor before you change how much you exercise, especially if you have a health condition or are pregnant. Stop if something hurts. Pay attention to where you’re walking, and never use Sole Mates while driving. You use Sole Mates at your own risk, and you’re responsible for your own safety.
Your data
Your steps and profile are yours. You let us use them to run Sole Mates, for example to show your steps to friends you’ve accepted and to people in challenges you join. Our Privacy Policy explains what we collect and how to delete it.
License
We give you a limited, personal, non-exclusive, non-transferable, revocable right to install and use Sole Mates on Apple-branded devices you own or control, as the App Store’s usage rules allow. Sole Mates is licensed to you, not sold. Don’t copy it, reverse-engineer it, overload it, scrape it, or use it to build a competing service. Follow any third-party terms that apply when you use it, such as your wireless carrier’s. Sole Mates is free to use. If we ever offer paid extras, we’ll say so clearly in the app before anything is charged. If you send us ideas or feedback, we can use them without owing you anything.
Pre-release versions
If you use Sole Mates through TestFlight or another pre-release program, you’re using unfinished software. It may have bugs, it may change without notice, and we may reset or delete pre-release accounts and data at any time. Apple’s TestFlight terms also apply.
Changes and ending
We may change, add or remove features, or stop running Sole Mates. We’ll give notice in the app or by email where we can, and at least 30 days’ notice if we shut Sole Mates down. You can delete your account at any time in Settings. We may suspend or end an account that breaks these terms, or that we reasonably believe is being used to harm Sole Mates or other people.
Apple
These terms are between you and us, not Apple. Apple isn’t responsible for Sole Mates or its content, has no duty to provide maintenance or support for it, and isn’t responsible for any claim by you or anyone else about Sole Mates or your use of it. If you got Sole Mates from the App Store, Apple’s standard Licensed Application End User License Agreement also applies, and Apple and its subsidiaries can enforce these terms as third-party beneficiaries. If Sole Mates fails to meet a warranty that applies by law, you can tell Apple, and Apple will refund what you paid for it, if anything; Apple has no other warranty duty for Sole Mates. We, not Apple, are responsible for any claims about the app, including product liability, legal compliance, consumer protection or intellectual property claims, and for investigating and defending any claim that the app infringes someone’s intellectual property. You confirm that you’re not in a country under a US government embargo or designated as a “terrorist supporting” country, and not on a US government list of prohibited or restricted parties. Questions, complaints and claims about Sole Mates go to Grant Road Studio LLC at the address in Contact.
No warranty
Sole Mates is provided “as is”, without warranties of any kind, as far as the law allows. That includes implied warranties, such as that it’s fit for a particular purpose or won’t infringe anyone’s rights. Step counts come from Apple Health and your devices, and they can be wrong, late or missing. We don’t promise that Sole Mates will always be available, free of errors, or that any data will be kept.
Limits on our liability
As far as the law allows, we’re not liable for indirect, incidental, special, punitive or consequential damages, or for lost data or lost profits, even if we were told they were possible. Our total liability for any claim about Sole Mates is limited to $50. Nothing in these terms limits liability that the law where you live doesn’t let us limit, such as liability for fraud, or for death or personal injury caused by our negligence. Some places don’t allow some of these limits, so they may not apply to you.
Disputes
If you have a problem, email us first and we’ll try to resolve it within 30 days. These terms are governed by California law, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in Alameda County, California, and you and we both agree to those courts, though either of us can use small claims court where we or you live. If you live somewhere that gives you consumer rights these terms can’t take away, you keep them.
If you break these terms
If someone makes a claim against us because you broke these terms or the law while using Sole Mates, you’ll cover our reasonable costs from that claim, including lawyers’ fees, as far as the law allows.
General
These terms and our Privacy Policy are the whole agreement between you and us about Sole Mates. We may send you notices in the app or by email, and those count as notice in writing. If a court decides part of these terms can’t be enforced, the rest still applies. If we don’t enforce a part right away, we haven’t given it up. You can’t transfer these terms to someone else; we can, if Sole Mates moves to a new owner. The parts that should last after your account ends, such as No warranty, Limits on our liability, If you break these terms and Disputes, still apply after it ends.
Changes to these terms
If we make an important change, we’ll tell you in the app or by email before it takes effect, and the date at the top will change. If you don’t agree with the new terms, delete your account before they take effect. If you keep using Sole Mates afterwards, the new terms apply.
